Description of Terms

The company is Industrial Training Services Limited, Essex, a provider of training, testing and assessment service to the industry.

The customer is the person, organisation or company who is contracted with the company for the provision of training/testing and or assessment services, including related literature & materials.

A “candidate(s)” is the person or persons who are being trained, tested and or assessed by the company.

Location and Facilities

Where the courses are undertaken on the customer’s premises or using the plant, vehicles or other equipment belonging to the customer, then the customer shall fully indemnify the company against all loss damage and claims from any party resulting from an act or negligence on the part of the customers’ employees or other candidates undertaking the course.

Attendance

The company reserves the right to refuse to accept any candidate onto a course, or refuse to continue training a candidate on the grounds of unacceptable behaviour, or an attitude which is inconsistent with a training environment.

In the event that a delegate arrives late for a course then our Training officer shall decide whether it is acceptable for the delegate to continue with the course, or whether they should repeat the course in order to be registered.

Payment

Our charges shall be defined in our quotation for the work. All of our accounts are subject to VAT at the prevailing rate. Where stated in our letter/quote the customer shall pay the full charge, by cheque, cash, or telegraphic transfer to the company at the time of booking the course and before the course is undertaken.

Unless otherwise stated in our letter the customer shall pay the charge to the company within 14 days of the date of invoice. The company reserves the right to charge interest on overdue accounts at the rate of 4% above the current base rate of the National Westminster Bank Plc, but payment of which shall not affect the obligation of the customer to pay the due amount before the due time.

Note: Credit card transactions will be charged at 2.5% above the value of the course. Debit cards are exempt from this surcharge.

Cancellation

If a booking form is returned to Industrial Training Services Ltd you are agreeing to our terms and conditions.

In the event that the customer cancels any or all of the courses/tests; cancellation charges apply as follows:

Courses / tests cancelled between 14 & 7 working days shall be charged at 50% of the fee

Courses / tests cancelled between 6 & 0 working days’ notice shall be charged at the full amount

In the unlikely event that the company is unable to proceed with a course/test on an agreed date the company shall not be liable for any consequential loss as a result of the postponement or cancellation of the course.

Note:

Any candidate who fails a CPCS theory test cannot progress onto the CPCS practical test. Any monies paid in advance for tests which run consecutively (same day) will not be reimbursed for the practical element following failure of the first.

We therefore recommend that these tests are booked separately.

Provision

The company shall be responsible only for providing competent training and assessment services and for completing the courses/tests that are run.

The company shall not be responsible for any loss or damage incurred by the customer in the event that any candidate fails to complete the course/tests or fails to meet the necessary standards to achieve a qualification.

The copyright of all plans, course notes, audio-visual material and other presentation material relating to the courses shall rest with Industrial Training Services Limited.

The customer shall not copy any of the material except with the written permission of the company.
